Terms and Conditions
These Terms and Conditions ("Terms") are an agreement between CallForges ("we", "us") and the business or person that creates an account or uses our services ("Customer", "you"). By creating an account, starting a trial or using CallForges, you agree to these Terms, our Privacy Policy and our Fair Usage Policy. If you accept on behalf of a company, you confirm you are authorised to bind it.
1. The services
CallForges is a cloud-based business phone service. It includes inbound and outbound calling over the internet, local and toll-free phone numbers, a preview and power auto dialer, call recording, AI transcription and summaries, an AI voice agent, call routing, and integrations with other software (together, the "Services"). You need a stable internet connection and a supported device to use the Services.
2. Emergency calls
CallForges is not a replacement for a traditional telephone line and does not support calls to emergency services, including 911 (US and Canada), 999 or 112 (UK) and 000 (Australia). You must keep another way to reach emergency services and tell your users about this limitation. We are not liable for any inability to reach emergency services through CallForges.
3. Accounts and users
- You must give accurate account and business information and keep it up to date.
- Each user licence is for one named person. Logins may not be shared.
- You are responsible for everything done under your account, and for keeping passwords and access secure. Tell us at once if you suspect unauthorised access.
- You must be at least 18 years old and use the Services for business purposes.
4. Phone numbers and porting
- We assign phone numbers to your account for your use. Numbers are regulated resources and you do not own them.
- Regulators in some countries, including the UK and Australia, require proof of name and address before a number can be assigned. You must provide this when asked, and we may withdraw a number if you do not.
- Porting in: we manage the porting process with your current carrier. Porting timelines depend on that carrier. Porting a US number costs $10; fees for other countries vary. You can port numbers during a free trial. You remain responsible for your contract with your previous provider.
- Porting out: you may move eligible numbers to another provider while your account is in good standing. Numbers in an unpaid or closed account may be released after 30 days.
- We may change or reclaim a number where a regulator or carrier requires it, or where it is used in breach of these Terms.
5. Plans, minutes and billing
- Subscriptions are charged per user licence, monthly or annually in advance, at the prices on our pricing page when you subscribe.
- Each user licence includes free minutes for calls to and from the US, Canada, UK and Australia: 100 per month on Starter, 500 on Business and 1,000 on Scale, and 50 inbound and 50 outbound minutes during a free trial, under our Fair Usage Policy.
- Usage beyond included allowances (calling minutes, AI voice agent minutes, call transcription, extra numbers and other add-ons) is billed per minute or per unit at published rates. Calls are billed per minute, rounded up to the next full minute.
- Credits: you can buy prepaid credits once you subscribe, or during a free trial once you add a payment card. Credits pay for extra numbers, minutes beyond your free allowance and AI voice agent minutes.
- Upgrades and added seats are not prorated.
- Prices exclude taxes and regulatory fees, which we add where required.
- Subscriptions renew automatically for the same term unless you cancel before the renewal date in your account settings.
- If a payment fails, we will tell you. If it is not paid within 14 days, we may suspend the Services until it is.
- Fees already paid are non-refundable except where the law requires otherwise or these Terms say so.
- We may change prices with at least 30 days' notice. Changes apply from your next renewal.
6. Free trials
Free trials run for 14 days unless we say otherwise, and we may extend a trial. During a trial you get one free local number in the US, UK, Canada or Australia, 50 inbound and 50 outbound minutes, and calls of up to 5 minutes each. A payment card is required for any number after the first. Adding a card removes the 5-minute call limit, lets you take up to 5 numbers per user and lets you buy credits. At the end of the trial, the account stops unless you choose a paid plan, and the trial number is removed. We do not charge you during a trial without your agreement.
7. Acceptable use
You must not use CallForges, or let others use it, to:
- Make calls or send messages that are unlawful, harassing, threatening, fraudulent or deceptive.
- Place unsolicited marketing calls, robocalls or pre-recorded calls without the consent the law requires.
- Display a caller ID you are not authorised to use, or hide or falsify caller ID to mislead the person called.
- Call numbers on do-not-call registers unless an exemption applies.
- Engage in traffic pumping, call arbitrage, reselling, or other uses described in the Fair Usage Policy.
- Upload malware, probe or disrupt our systems, or try to access other customers' data.
- Record, transcribe or analyse calls without the notice and consent the law requires.
- Infringe anyone's intellectual property or privacy rights.
8. Calling laws you must follow
You are responsible for making sure your calls, messages and recordings follow the laws of every country you call from and to. Depending on where you and your contacts are, these include:
- United States: the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the National Do Not Call Registry, STIR/SHAKEN caller ID rules, and state telemarketing, calling-hours and recording laws.
- Canada: the CRTC Unsolicited Telecommunications Rules and the National Do Not Call List.
- United Kingdom: the Privacy and Electronic Communications Regulations (PECR), the Telephone Preference Service and Corporate TPS, UK GDPR, and Ofcom's rules on persistent misuse, including abandoned and silent calls.
- Australia: the Do Not Call Register Act 2006, the Telecommunications (Telemarketing and Research Calls) Industry Standard, the Spam Act 2003 and state surveillance and listening-device laws.
We may provide tools that help, such as calling-hour limits, do-not-call list uploads and recording announcements. Using those tools does not make us responsible for your compliance.
9. Auto dialer
The CallForges auto dialer calls one contact at a time (preview and power modes). When you use it, you must:
- Have the consent or lawful basis required to call each contact on your lists.
- Screen lists against the do-not-call registers that apply, and honour opt-out requests promptly.
- Set calling hours that match each contact's local time and the rules of their country or state.
- Connect every answered call to a live person or a lawful recorded message, and keep abandoned and silent calls within legal limits.
We may limit or disable the dialer on an account if its usage suggests a breach of these Terms or of calling laws.
10. Call recording and transcription
Recording and transcription laws differ by country and, in the US and Australia, by state. Some require every party on the call to consent. You decide whether to record and transcribe calls, and you are responsible for giving any required notice (for example, an announcement at the start of the call) and obtaining any required consent. You can turn recording and transcription on or off for users, numbers and teams. Transcription is billed per transcribed minute at the published rate.
11. AI features
- AI features, including transcription, summaries, action items, translation, coaching and the AI voice agent, are generated automatically and may be incomplete or wrong. Review important outputs before you rely on them.
- The AI voice agent must tell callers they are speaking with an automated assistant, and callers must be able to reach a person or leave a message. You must not configure the agent to pretend to be human.
- You are responsible for the instructions, knowledge sources and documents you give the AI voice agent, and for the answers it gives from them.
- Do not use AI features to make decisions with legal or similarly significant effects on a person without human review.
- We use carefully selected third-party AI providers to process call audio and text. They process your data only to provide the feature to you and are not allowed to use it to train their own models.
- We do not use your call recordings or transcripts to train AI models without your written consent. We may use aggregated, de-identified usage data to improve the Services.
12. Your data
You own the data you and your users put into CallForges, including contacts, call recordings, voicemails, transcripts and AI outputs ("Customer Data"). You give us permission to host, process and transmit Customer Data only as needed to provide, secure and support the Services. For Customer Data we act as your processor, and our Privacy Policy and Data Processing Addendum (available on request) apply. You can export Customer Data while your account is active and for 30 days after it closes, after which we delete it as described in our Privacy Policy.
13. Third-party integrations
If you connect CallForges to other services, such as a CRM, calendar or messaging tool, your use of those services is governed by their terms. You authorise us to exchange data with them as needed for the integration. We are not responsible for third-party services or changes they make.
14. Intellectual property
We own the Services, our software, designs and brand. We give you a limited, non-exclusive, non-transferable right to use the Services during your subscription, for your internal business purposes. You must not copy, resell, reverse engineer or build a competing product from the Services. If you send us feedback, we may use it without obligation to you.
15. Confidentiality
Each party will keep the other's non-public business information confidential, use it only for this agreement, and protect it with reasonable care. This does not apply to information that is public, already known, independently developed, or that must be disclosed by law.
16. Availability and changes
We work to keep CallForges available and call quality high, but internet-based calling depends on networks and carriers outside our control, and we do not promise uninterrupted service. We may carry out maintenance, and we will try to schedule planned work outside business hours and give notice where practical. We may add, change or remove features. If we remove a major feature you pay for, we will give reasonable notice.
17. Suspension and termination
- You can cancel at any time in your account settings. Cancellation takes effect at the end of your current billing term.
- We may suspend or restrict your account immediately if you breach sections 7 to 11, if a carrier or regulator requires it, if payment is overdue, or to stop fraud or harm to our network or others.
- Either party may end this agreement if the other materially breaches it and does not fix the breach within 30 days of written notice.
- When the agreement ends, your right to use the Services stops, unpaid fees become due, and sections that by their nature should survive (including 12, 14, 15, 18, 19, 20 and 21) continue to apply.
18. Disclaimers
Except as expressly stated in these Terms, the Services are provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded, including the Australian Consumer Law.
19. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Each party's total liability arising from this agreement is limited to the fees you paid to us in the 12 months before the event giving rise to the claim. These limits do not apply to your payment obligations, your indemnity under section 20, or liability that cannot be limited by law.
20. Indemnity
You will defend and indemnify CallForges against claims, fines and costs arising from your calls, recordings, messages, contact lists, AI agent configuration, or breach of these Terms or of the calling and privacy laws in section 8.
21. Disputes
Before starting formal proceedings, both parties will try in good faith to resolve a dispute by discussion for at least 30 days. Either party may seek urgent relief in any competent court.
22. Changes to these Terms
We may update these Terms. We will give at least 30 days' notice of material changes by email or in the app. If you keep using CallForges after the change takes effect, the new Terms apply. If you do not agree, you may cancel before that date.
23. General
- Neither party is liable for delays caused by events beyond its reasonable control, such as carrier outages, natural disasters or government action.
- You may not assign this agreement without our consent. We may assign it to a successor in a merger or sale of our business.
- If a provision is found unenforceable, the rest of these Terms remain in effect.
- A failure to enforce a right is not a waiver of it.
- These Terms, with the policies they refer to and any order form, are the entire agreement between us about the Services.
- We may send notices by email to your account owner. You may send notices to the address below.
